Wildlife Conservation Society “Turning Red” Sweepstakes (the “Sweepstakes”) starts at 9:00am Eastern Time (“ET”) on March 16, 2022 and ends at 5:00pm ET on March 16, 2022 (the “Sweepstakes Period”). The sponsor of this Sweepstakes is the Wildlife Conservation Society (“Sponsor”), with a principal place of business at 2300 Southern Boulevard, Bronx, NY 10460. This Sweepstakes shall be subject to these Official Rules, and by entering, all entrants agree to be bound by the terms and conditions herein. Certain restrictions may apply.
ELIGIBILITY: This Sweepstakes is open only to individuals who are legal residents of the fifty (50) United States (not including territories and possessions) and the District of Columbia who are eighteen (18) years of age or older as of the date the Sweepstakes begins. The officers, trustees, directors, partners, agents and employees of Sponsor, Allied Advertising, Limited Partnership (“Allied” or “Prize Supplier”), Walt Disney Studios Motion Pictures (“Disney”), and Pixar Animation Studios (“Pixar”) and each of their respective affiliates, parents, subsidiaries, divisions, licensors, representatives, distributors, and advertising, production and promotion agencies (all of the foregoing, collectively, the “Sweepstakes Entities”), and the immediate family members and those living in the same household of the foregoing, are not eligible to enter. No purchase is necessary to enter this Sweepstakes. All federal, state and local rules and regulations apply. Void where prohibited by law.
HOW TO ENTER: Entrants may enter this Sweepstakes at any time during the Sweepstakes Period by finding the Bronx Zoo’s Facebook post relating to “Turning Red” posted at 9:00am ET on March 16, 2022 (the “Sweepstakes Post”) and leaving a comment on the Sweepstakes Post saying what the entrant loves most about red pandas. Entrants must have an account on Facebook in order to be able to enter this Sweepstakes. Establishing an account on Facebook is free. Entrants must take the commenting action as required in order for entries to be eligible. One comment as required will equal one (1) entry. All entries must be in English. Each Entrant is responsible for ensuring that his/her/their Facebook account’s privacy settings will allow Sponsor to view his/her/their comment and communicate privately with him/her/them. An entrant can resume his/her/their Facebook account’s original privacy settings any time after the winner has been determined. All entries must be received by the 5:00pm ET on March 16, 2022 to be eligible.
Limit one (1) entry per person/Facebook account for the duration of the Sweepstakes. Entries received from any person/Facebook account in excess of the limit will be void. Any attempt to use multiple accounts or other tactics to enter more than the limit may result in the disqualification by Sponsor of entrant from the Sweepstakes and all associated entries will be void. Entries generated by script, macro or other automated or mechanical means or by any means which subvert the entry process will be void. False, fraudulent or deceptive entries or acts shall render entrants ineligible and disqualified. Entries and any related content deemed by Sponsor in its sole discretion to contain offensive, derogatory, obscene, infringing or other inappropriate or unlawful content are prohibited and will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned.
WINNER SELECTION AND NOTIFICATION: Odds of winning depend on the number of eligible entries received. Sponsor will randomly select ONE (1) winner from among eligible entries on or about March 17, 2022. Winner will be notified by private message on Facebook to winner’s comment on the Sweepstakes Post by March 18, 2022 and must respond to such notification within the time period set forth in the notification to claim the prize. Winner must confirm and verify his/her/their identity to Sponsor’s satisfaction, provide his/her/their mailing address to Sponsor, and execute and return an Affidavit of Eligibility/Release of Liability/Publicity Release by March 24, 2022. Sponsor will cause the prize to be mailed by the Prize Supplier to winner at the mailing address provided by winner. If the potential winner cannot be contacted, fails to reply to the winner notification as requested, is ineligible, fails to execute and return an Affidavit of Eligibility/Release of Liability/Publicity Release as requested, fails to claim the prize in a timely manner, or otherwise fails to comply with these Official Rules, then such potential winner will be disqualified and an alternate winner may be selected, time permitting. Sponsor reserves the right to verify the eligibility of the winner.
Acceptance of the prize constitutes permission for Sponsor to use the winner's name, address (city and state), likeness, winning entry and statements for promotional and publicity purposes in any media now known or hereinafter developed, in perpetuity, without additional consideration or compensation, permission, notification or limitation unless prohibited by law.
All decisions of Sponsor regarding the selection, notification and substitution of the winner in accordance with these Official Rules shall be binding and final.
PRIZE: One (1) winner will receive a gift pack related to the Disney Pixar film “Turning Red”, which gift pack is expected to consist of one (1) Mei red panda plush, one (1) Mei red panda baseball cap (size: children’s), one (1) pair of Mei red panda slippers (size: children’s 9/10), one (1) Mei red panda robe (size: children’s 9/10), and one (1) blanket in one (1) Mei red panda plush bag; however, actual items may vary and will be as determined by Sponsor consistent with the prize’s approximate retail value (“ARV”). Total ARV of prize: $200. Sponsor will provide winner’s name and mailing address to the Prize Supplier in order to enable the Prize Supplier to deliver the prize to winner. By providing his/her/their name and mailing address, winner consents to the sharing of this information with the Prize Supplier. Winner may not make prize substitutions. Prize is not transferable or redeemable for cash.
At Sponsor’s sole discretion, Sponsor may substitute the prize listed above, including any part thereof, with one of comparable or greater value.
All applicable federal, state and local taxes, duties, tariffs, title fees, licensing fees, or other fees associated with the acceptance and/or use of the prize, if any, are the sole responsibility of the prize winner.
LIMITATION OF LIABILITY: Neither Sponsor nor any of the Sweepstakes Entities shall be liable to the winner or any other persons for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, epidemic or pandemic, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond Sponsor's and/or any Sweepstakes Entity’s reasonable control.
Sponsor is not responsible or liable to any entrant or any other persons for any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone, broadband, wireless or other network, computer online system, postal service, computer equipment, server, provider, mobile device or software, including without limitation any injury or damage to entrant’s or any other person’s computer or mobile device relating to or resulting from participation in this Sweepstakes; inability to access the entry site; theft, tampering, destruction, or alteration of, or unauthorized access to, entries; data that is processed late or incorrectly or that is incomplete or lost due to computer or electronic malfunction or traffic congestion on transmission lines or the Internet or the entry site or for any other reason whatsoever; typographical, printing or other errors; or any combination thereof.
RIGHTS GRANTED BY ENTRANTS: By entering this Sweepstakes, each entrant understands and agrees that Sponsor, anyone acting on behalf of Sponsor, and Sponsor’s licensees, successors, and assigns shall have the right, where permitted by law, in all media worldwide in perpetuity, without remuneration, to use the entrant’s image, likeness, voice and statements provided by the entrant in connection with this Sweepstakes for Sponsor’s institutional, educational and promotional purposes and for publicizing any corporate sponsor’s support of or role in the Sweepstakes. Each entrant must also secure the permission of any recognizable person (or in the case of a minor, the minor’s parent or guardian) whose image or likeness appears in any photograph or video for all purposes described herein, and present satisfactory evidence of such permission to the Sponsor if requested. The Sponsor reserves the right to disqualify any entry if the Sponsor finds, in its sole discretion, that an entrant has not secured the necessary permission.
SOCIAL MEDIA ACTIVITY: This Sweepstakes is in no way sponsored by, endorsed by, administered by or associated with Facebook. Each entrant releases any and all claims he/she/they may have against Facebook for any and all injuries, claims, damages, losses, costs or expenses of any kind (including without limitation attorneys' fees) in connection with this Sweepstakes. Entrants hereby consent to Sponsor’s collection of user content and information as provided for in these Official Rules. Entrants acknowledge that any such information is being collected by Sponsor and not Facebook. Entrants are reminded that their Facebook activity is subject at all times to the Facebook rules.
GENERAL: Entrants release and waive any claims they may have against Sponsor and the Sweepstakes Entities for any and all injuries, claims, damages, losses, costs, or expenses of any kind (including without limitation attorneys’ fees) resulting from acceptance, use, or misuse of the prize or any portion thereof; participation in this Sweepstakes; or any technical malfunctions of the telephone network and/or transmission line, computer on-line system, postal service, computer, mobile device or transmission device or its dating mechanism, equipment, hardware, software, or any combination thereof, or any entries that are late (including delayed data transmissions), tampered with, garbled, incomplete, misdirected, lost, mutilated, delayed, corrupted, mechanically duplicated, illegible or otherwise not in compliance with these Official Rules. By entering this Sweepstakes, entrants affirm that they have read and accepted these Official Rules. This Sweepstakes shall be governed by and construed in accordance with the laws of the State of New York. By entering this Sweepstakes, entrants hereby submit to the jurisdiction and venue of the federal and state courts of New York and waive the right to have disputes arising out of the subject matter hereof adjudicated in any other forum.
If for any reason it is not possible to operate this Sweepstakes as planned, or if this Sweepstakes or any web site or account address associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of this Sweepstakes and processing of entries therefor in accordance with these Official Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof. In the event this Sweepstakes is canceled or terminated, Sponsor will conduct a random drawing to award the prize from among all eligible, non-suspect entries received prior to the time of the action or event warranting such cancellation or termination. If such cancellation, termination, modification, or suspension occurs, notification will be posted at the entry site.
If a dispute arises about who submitted an entry on the entry site, the entry will be deemed submitted by the authorized account holder of the email account associated with the entry. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet access provider, service provider, or other online organization with such responsibility. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met.
Notwithstanding the foregoing, Sponsor reserves the right, in its sole discretion, to cancel or modify this Sweepstakes for any reason or no reason.
